Recently, Mr. Owen helped overturn the convictions of a man and woman from Mansfield, Ohio who were framed by the DEA, which hired agents that used stand-in actors to impersonate the man and woman during staged drug deals.
He also helped free two Columbus men, Timothy Howard and Gary James, who were both convicted and sentenced to death in 1977 for a robbery and murder at an East-side Columbus bank. Mr. Owen became involved in the case in 1997, more than 20 years after their convictions. On April 17, 2003, Mr. Howard was granted a new trial based on compelling new evidence of innocence. On July 17, 2003, Mr. James was also granted a new trial. Shortly thereafter, the State of Ohio dismissed all charges against both men and expunged their convictions. With his representation, both men were later found to have been wrongfully imprisoned and received the two highest wrongful imprisonment awards in Ohio history.
Mr. Owen also represented two Akron-area men, Randy Resh and Robert Gondor, in state post-conviction litigation. These two clients were indicted in 1990 for death penalty murder, and were subsequently convicted and sentenced to lengthy terms of imprisonment. After extensive litigation initiated by Mr. Owen, culminating in an eight-day evidentiary hearing, both men were granted new trials on June 14, 2002, based on compelling new evidence of innocence. After the State of Ohio appealed, Mr. Owen argued the case before the Ohio Supreme Court where the Court affirmed the trial court’s decision granting post-conviction relief in a unanimous decision rendered on December 26, 2006. Both men have since been exonerated of all charges.
In 1986, Mr. Owen obtained the first acquittal by a jury in a capital murder case under Ohio’s 1981 death penalty law. Since then, he has received more jury acquittals in death penalty murder trials than any other lawyer licensed in Ohio.
Just last month, Mr. Owen obtained another in a long string of acquittals, this one coming from a Murder case he tried to a jury in Springfield, Ohio.
Mr. Owen has represented Centurion Ministries, Inc., a Princeton-based nonprofit corporation founded and operated by Jim McCloskey that works for the release of the wrongfully convicted. Centurion Ministries has freed 46 innocent men and women throughout the country who were either on death row or serving life sentences. Mr. McCloskey was profiled in U.S. News & World Report in 2001 as one of 20 living American heroes of our time.
Mr. Owen has also represented judges and other elected officials in a variety of legal matters; and most recently has served as legal advisor to the Ohio Secretary of State in nineteen separate lawsuits filed against the office prior to the Secretary’s election in 2006.
Mr. Owen has been fighting for the Constitutional rights of citizens across the county for nearly 30 years, and has provided a powerful voice for all of our rights through his work defending the accused.
